1. About these terms

These Terms of Service (“Terms”) govern your access to and use of the scanzai website, tools, reports, recommendations, and all related services (collectively, the “Service”) operated by scanzai (“we”, “us”, or “our”). These Terms constitute a legally binding agreement between you (“User”) and us. We reserve the right to update these Terms at any time. Continued use of the Service after any update constitutes acceptance of the revised Terms.

2. Nature of the service

Scanzai offers two distinct kinds of service:

• Free scan — automated website analysis, performance scoring, and general guidance for informational purposes only. Free-scan outputs do not constitute professional advice of any kind (legal, financial, technical, SEO, or business).
• Paid plans (Starter, Complete, and Ongoing care) — hands-on installation and/or ongoing care work performed by a real person on your existing website and related business profiles, as described at purchase and in our offer materials.

Free-scan audit results, scores, and recommendations are produced by automated systems and third-party APIs. They reflect a point-in-time snapshot of publicly accessible website data and may be incomplete, outdated, or inaccurate. You should independently verify findings before making business decisions based solely on a free scan.

2A. Scope of paid work & temporary access

When you purchase Starter, Complete, or Ongoing care, you authorize us to perform the agreed installation and/or care tasks on systems you control (for example your website platform, Google Business Profile, and related tools). To do that work we may need temporary collaborator or admin access that you grant. You are responsible for providing accurate credentials or invites, and for revoking access when the work is complete unless Ongoing care requires continued access by agreement.

Paid services are currently offered as described on our pricing and contact pages. Scope is limited to what we confirm in writing (including email) for your project. We do not take ownership of your business accounts; access is solely to deliver the purchased work.

3. No guarantee of results

We make no representations, warranties, or guarantees — express or implied — that use of the Service, a free scan, or paid installation/care will result in any specific outcome, including but not limited to:

• Improved search engine rankings or Google visibility
• Increased website traffic, leads, bookings, or conversions
• Higher revenue or return on investment
• Faster page load times or improved Core Web Vitals scores
• Compliance with any third-party platform requirements

Any illustrative examples, industry averages, or projected improvements shown in marketing or reports are not personalized forecasts. Actual results vary based on your market, competition, operations, and factors outside our control.

4. Accuracy of audit data

Audit scores are derived from Google PageSpeed Insights API (Lighthouse) and may differ from scores you see in other tools, at different times, or under different network conditions. We do not control Google's API output, scoring algorithms, or availability. Score results can vary based on:

• Server response time at the moment of the scan
• Third-party scripts or resources on your site
• Geographic location of the testing server
• Temporary caching, CDN, or infrastructure states
• Dynamic content or personalization on the page

We do not warrant that any audit result is complete, accurate, or fit for any particular purpose. You use all audit data entirely at your own risk.

5. Third-party services

The Service relies on third-party providers for core functionality. We do not control their APIs, uptime, security practices, documentation, or terms. Their failures or changes may affect the Service without notice and without liability to you.

Depending on features you use, processing may involve (among others):

• Google PageSpeed Insights / Lighthouse — audits of URLs you submit.
• Vercel — hosting and infrastructure; in production we may use Vercel Analytics for aggregated usage metrics (see Cookie Policy).
• Resend — transactional email delivery from the scanzai.com domain when you request report or action emails.
• Payment processors — when you purchase paid Starter, Complete, or Ongoing care services.
• Tools installed on your site— as part of paid work we may configure third-party tools you approve (for example booking, chat, analytics, or review tools), each subject to that vendor's terms.

Your use of the Service constitutes direction for us to engage these providers as reasonably necessary to deliver the Service, subject to the disclosures in our Privacy Policy.

6. Acceptable use

By using the Service, you agree that you will not:

• Submit URLs you do not own or are not authorized to analyse
• Use the Service to scan, probe, or attack third-party websites
• Attempt to reverse-engineer, scrape, or copy any part of the Service
• Misrepresent your identity or submit false information
• Use the Service for any unlawful, fraudulent, or abusive purpose
• Overload or interfere with our infrastructure through automated requests

We reserve the right to suspend or terminate access for any user who violates these rules, at our sole discretion and without prior notice.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL scanzai, ITS OWNERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY:

• Indirect, incidental, special, punitive, or consequential damages
• Loss of profits, revenue, data, business, or goodwill
• Damages arising from reliance on any audit result, report, or recommendation
• Damages from inability to access the Service or from service interruption
• Damages caused by third-party services, tools, or APIs used by the platform

Our total aggregate liability to you for any claim arising from use of the Service shall not exceed the greater of (a) $500, or (b) the total fees you paid us for the Service in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including mandatory consumer protections). Where such rules apply, our liability is limited to the fullest extent permitted.

9. Indemnification

You agree to defend, indemnify, and hold harmless scanzai and its owners, employees, contractors, and affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content or URLs you submit through the Service.

10. Payments and refunds

The free audit tool is provided at no cost. Where paid services, action plans, or implementation packages are purchased:

• If we haven't started work yet, email hello@scanzai.com within 7 days and we'll refund you — we don't lock you into anything. Contact hello@scanzai.com
• Once work has started, fees for work already performed are non-refundable unless we agree otherwise in writing
• We do not issue refunds based on dissatisfaction with audit results, score outcomes, or recommendation accuracy
• Chargebacks or disputes filed without prior contact will result in immediate termination of access and may result in further action

11. Intellectual property

All content, design, code, branding, reports, and materials on the Service are the property of scanzai or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our express written permission. Audit reports generated for your own website may be used internally by you, but may not be resold or redistributed.

12. Privacy & cookies

Your use of the Service is governed by our Privacy Policy and Cookie Policy, each incorporated into these Terms by reference. By using the Service, you acknowledge our data practices described there — including that we do not sell your personal information as described in the Privacy Policy.

13. Modifications to the service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and without liability to you. We may also change pricing, features, or availability at our discretion.

14. Governing law and disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence require otherwise.

• You agree to first contact us at hello@scanzai.com and attempt to resolve the dispute informally within 30 days
• If unresolved, disputes may be brought in the Dutch courts. If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your EU member state of residence

Nothing in these Terms limits rights you may have under mandatory EU or national consumer law that cannot be waived by contract.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Entire agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and scanzai regarding your use of the Service and supersede all prior understandings or agreements on the subject.

17. Contact

The data controller for personal data processed through the Service is scanzai, established in the Netherlands for GDPR purposes. Company registration details (and VAT number, if applicable) will be published here when available — we will not invent registration numbers.
